These Terms and Conditions ("Terms") govern your use of the Treadsetters Tyres Ltd website and your purchase of tyres, retreading services and related products from Treadsetters Tyres Ltd ("Treadsetters", "we", "us" or "our"), a company operating in Kenya with offices in Nairobi (Ruaraka and Mombasa Road) and Mombasa. By placing an order or using our website, you agree to be bound by these Terms.
1. About Us
Treadsetters has been in the tyre industry since 1987 and is the largest retreading organisation in Sub-Saharan Africa, offering new tyres, retreaded tyres, and Tyre Optimization Process and Solutions (TTOPS) to customers across Kenya, including public transport, general cargo and agricultural sectors.
2. Products and Pricing
- All prices displayed are in Kenya Shillings (KES) and are inclusive of Value Added Tax (VAT) unless otherwise stated, in accordance with Kenyan tax law.
- We reserve the right to change prices, product specifications and availability without prior notice.
- We make reasonable efforts to ensure product descriptions and images are accurate, but slight variations in tyre appearance, tread pattern or packaging may occur.
- Unless expressly stated otherwise, tyres are sold on their own and do not include rims/wheels. Rims are not part of the tyre purchase and, where required, must be sourced or purchased separately.
3. Orders and Payment
- An order is only confirmed once payment has been received or a payment arrangement (e.g. corporate credit account) has been approved by us.
- We accept payment via M-Pesa, bank transfer, card payment, and approved corporate credit terms.
- We reserve the right to refuse or cancel any order, including in cases of suspected fraud, pricing errors, or stock unavailability, in which case any payment received will be refunded.
4. Delivery
- Delivery is currently only available within Nairobi. Customers outside Nairobi may collect orders directly from our branches or arrange their own transport.
- Delivery timelines are estimates and may vary due to traffic, weather, location or stock availability.
- Risk in the goods passes to you upon delivery. Please inspect goods upon receipt and report any damage or discrepancy within 48 hours.
- Delivery charges, where applicable, will be communicated at the point of order.
5. Warranty and Returns
- New tyres are covered by the applicable manufacturer's warranty (e.g. Armstrong) against manufacturing defects, subject to the manufacturer's terms.
- Retreaded tyres and TTOPS services are covered by our internal workmanship warranty, the terms of which will be provided at the time of service.
- Warranty claims must be accompanied by proof of purchase and are subject to inspection by our technical team. Warranty does not cover damage caused by misuse, road hazards, improper inflation, misalignment, or normal wear and tear.
6. Limitation of Liability
To the fullest extent permitted under Kenyan law, Treadsetters shall not be liable for any indirect, incidental or consequential loss arising from the use of our products or services, except in cases of gross negligence or wilful misconduct. Nothing in these Terms excludes or limits any right you have under the Consumer Protection Act, 2012 of Kenya, which shall prevail to the extent of any conflict.
7. Consumer Rights
Nothing in these Terms affects your statutory rights as a consumer under Kenyan law, including your right to goods that are of satisfactory quality, fit for purpose, and as described.
8. Intellectual Property
All content on our website, including the Treadsetters name, logo, text, graphics and images, is the property of Treadsetters Tyres Ltd and may not be used without our prior written consent.
9. Website Use
You agree to use our website only for lawful purposes and not to engage in any activity that could damage, disable or impair our website or interfere with any other party's use of it.
10. Governing Law and Jurisdiction
These Terms are governed by the laws of the Republic of Kenya. Any disputes arising from these Terms or your use of our products and services shall be subject to the exclusive jurisdiction of the courts of Kenya.
11. Changes to These Terms
We may revise these Terms from time to time. The updated version will be posted on this page with a revised "Last updated" date, and continued use of our website or services constitutes acceptance of the updated Terms.
